    Former SDNY prosecutor Maurene Comey sues over her firing

    Former Southern District of New York prosecutor Maurene Comey alleged in a lawsuit Monday that her ouster from the U.S. Lawyer’s workplace was “illegal and unconstitutional” and sure occurred due to who her father is.

    Comey, who prosecuted high-profile defendants together with Sean Combs, Robert Hadden, Jeffrey Epstein and Ghislaine Maxwell, was fired in July. 

    Her lawsuit stated President Donald Trump, the Justice Division, Lawyer Normal Pam Bondi and different defendants didn’t establish a trigger or present her due course of.

    “In fact, there isn’t any respectable rationalization. Relatively, Defendants fired Ms. Comey solely or considerably as a result of her father is former FBI Director James B. Comey, or due to her perceived political affiliation and beliefs, or each,” the lawsuit stated, referring to the previous FBI director who Trump fired throughout his first time period as president as a result of he initiated the investigation into allegations of Russian meddling within the 2016 election.

    “The politically motivated termination of Ms. Comey — ostensibly beneath “Article II of the Structure” — upends bedrock rules of our democracy and justice system. Assistant United States Attorneys like Ms. Comey should do their jobs with out fearing or favoring any political get together or perspective, guided solely by the legislation, the details, and the pursuit of justice,” the lawsuit stated.

    Comey stated she had simply been assigned a high-profile public corruption case when she obtained an electronic mail on July 16 at 4:57 p.m. with a memo informing her that “your employment with the Division of Justice is hereby terminated, and you’re faraway from federal service efficient instantly.”

    In line with the lawsuit, Comey’s supervisors “had been visibly shocked and upset,” and Jay Clayton, the US Lawyer for the Southern District of New York, offered no rationalization.

    “All I can say is it got here from Washington. I can not let you know the rest,” the lawsuit quoted Clayton as telling Comey. 

    Comey’s attorneys stated the president lacks the authority to fireplace bizarre federal prosecutors, who’re profession civil servants, for perceived disloyalty. 

    “Neither the President nor the Division of Justice have limitless authority to take away Assistant United States Attorneys,” the lawsuit stated.

    Comey is searching for reinstatement together with again pay.
